(Artwork Sales & Commissions)

By purchasing artwork or commissioning a piece from Art by Poppet, you agree to the following Terms & Conditions.
1. About the Seller
Art by Poppet is operated by Joanne Marie Real, a self-employed (autónomo) artist based in Spain.
All sales are conducted in accordance with applicable Spanish and European Union consumer protection laws.
2. Original Artwork
All original artworks are unique, one-of-a-kind pieces.
Each artwork:
Is signed and dated
Includes a Certificate of Authenticity
Is carefully packaged for protection
Due to differences in screen settings and photography, colours may vary slightly from what appears online.
Original artworks are non-returnable unless they arrive damaged or faulty.
3. Limited Edition & Open Edition Prints
Limited edition and open edition prints are produced using high-quality professional printing processes and archival materials.
Edition sizes (where applicable) are clearly stated on the product page.
All prints are sold as physical goods.
4. Commissions
A 30% non-refundable deposit is required to secure a commission booking.
The remaining balance is due upon completion and prior to dispatch or collection.
Due to the bespoke and personalised nature of commissioned artwork, commissions are non-refundable once work has commenced.
Minor adjustments may be discussed during the process; however, artistic style and interpretation remain at the discretion of the artist.
5. Pricing & VAT
All prices are listed in Euros (€) unless stated otherwise.
Prices include applicable VAT (IVA) where required by law.
Prices may change without notice; however, confirmed orders and commissions will not be affected.
6. Shipping & Delivery
Shipping costs and estimated delivery times are displayed at checkout.
Processing times (the time required before dispatch) vary depending on the product type and will be stated on the product page.
Estimated delivery times are provided as guidance only.
While every effort is made to meet estimated delivery dates, delays caused by postal services, courier companies, or customs authorities are outside the control of Art by Poppet.
Buyers are responsible for any customs duties, import taxes, or additional charges that may apply in their country.
7. Right of Withdrawal (EU Consumers)
In accordance with EU consumer protection law, customers within the European Union have the right to withdraw from their purchase of standard (non-custom) physical goods within 14 days of delivery.
To exercise this right, the buyer must notify Art by Poppet in writing within 14 days of receiving the item.
Returned items must:
Be unused
Be in their original condition
Be returned in original packaging
Return shipping costs are the responsibility of the buyer unless the item is faulty or damaged.
Refunds will be processed once the returned item has been received and inspected.
This right of withdrawal does not apply to:
Commissioned artwork
Custom-made or personalised pieces
8. Damaged or Faulty Items
If an item arrives damaged or faulty, this must be reported within 48 hours of delivery.
Clear photographic evidence of both the item and the packaging must be provided.
A replacement or refund will be arranged where appropriate.
9. Copyright & Intellectual Property
All artwork remains the intellectual property and copyright of Art by Poppet (Joanne Marie Real).
Purchase of artwork does not grant reproduction rights unless explicitly agreed in writing.
Artwork may not be reproduced, distributed, or used for commercial purposes without prior written consent.
10. Limitation of Liability
Art by Poppet shall not be liable for indirect or consequential losses arising from the use or inability to use purchased artwork.
Nothing in these Terms limits statutory consumer rights.
